Dubai court obliges an Arab woman to "obey" her husband

In a significant ruling, the Personal Status Court in Dubai has dictated that an Arab woman must comply with her husband's directive to return to their shared residence. Failure to adhere to this order could result in the woman being labeled as disobedient, leading to the cessation of her alimony.

Dubai Court's Ruling: Complex Marital Dispute Unveiled

The wife filed a divorce lawsuit, which focused on accusations that her husband had harmed her. The dismissal was attributed to the absence of concrete evidence supporting allegations of harm, discord, and financial negligence.

Additionally, the court turned down her requests for a deferred dowry in the form of a gold coin and other divorce-related demands.

Elaborate Legal Battle: Wife's Allegations and Requests

The wife, in her legal pursuit, detailed instances of mistreatment, including physical assaults, verbal abuse, and forced eviction from their marital home. Despite having two children with her husband, she asserted that he abandoned her before the birth of their second daughter and refrained from providing financial support despite being financially capable.

Her legal memorandum outlined a series of requests, including an irrevocable divorce, payment of backdowry in a gold coin or its dirham equivalent, spousal support, and custody of the children. Additionally, she sought financial provisions, such as monthly maintenance, annual rent for a nursery residence, and furnishing allowances.

Counter-Lawsuit by the Husband: Allegations and Demands

The husband, in response, filed a countersuit through his legal representative, Nour Al-Saqqa Amini. He contended that the marital relationship existed and that the wife's refusal to return to their shared home was without cause, as he had treated her well. He emphasized the absence of a genuine disagreement requiring divorce and denied abandoning her in bed.

Amini presented a narrative where the husband discovered the wife had packed her belongings and the children's possessions, relocating them to an undisclosed location during a move between houses. This prompted the husband to involve the police, revealing a dispute. The wife's admission to not wanting to move to the new marital home further complicated the matter.

Unsuccessful Reconciliation: Escalation of Legal Battle

Efforts for reconciliation through the Family Guidance Committee proved unsuccessful, leading to a series of reply memoranda exchanged between the parties. The wife denied accusations of taking belongings and changing apartment locks, asserting her expulsion from the residence. Disputes over custody, expenses, and legal fees intensified.

Court Decision: A Complex Verdict

After scrutinizing the case and the submissions from both parties, the court made several key decisions:

  1. rejecting the wife's divorce plea due to unproven harm.
  2. Denying the deferred dowry requested by the wife
  3. Ruling in favor of the wife's custody of the children and obliging the husband to provide financial support for their well-being
  4. In the joint lawsuit by the husband, the court mandated the wife's obedience to return to the marital residence or face potential alimony forfeiture.

This legal saga showcases the complexities and challenges involved in marital disputes, with each party presenting contrasting narratives and seeking resolution through the legal system.
